Agreement for Back In The Day Video Sales Services
THE FOLLOWING DESCRIBES THE TERMS ON WHICH BACK IN THE DAY OFFERS YOU ACCESS TO OUR VIDEO SALES SERVICES.
This User Agreement ("Agreement") is a contract between you and Back In The Day and applies to your use of the Back In The Day service and any related products and services available through www.backintheday2000.com (collectively the "Service"). If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our Services.
You must read, agree with, and accept all of the terms and conditions contained in this Agreement before you may become a member of Back In The Day. We strongly recommend that, as you read this Agreement, you also access and read the information contained in the other pages and websites referred to in this document, as they may contain further terms and conditions that apply to you as a Back In The Day user. Please note: underlined words and phrases are links to these pages and websites. By accepting this Agreement, you also agree that your use of other Back In The Day websites and Services will be governed by the terms and conditions posted on those websites.
We may amend this Agreement at any time by posting the amended terms on the agreement page on our site. All amended terms shall be effective as soon as they are posted on our site. Also all changes will be posted on the "Updates" page, accessible from "Updates" link on the left side of your screen once you have went to the home page.
In this Agreement, "you" or "your" means any person or entity using the Service ("Users"). Unless otherwise stated, "Back In The Day," "we" or "our" will refer collectively to and its subsidiaries. Unless otherwise specified.
1. HONESTY IS THE BEST POLICY.
Unfortunately not everyone who e-mails me and/or views the websight are honest people. There are people who work for studios and production companies that pose as "collectors" and "traders" and "costumers" with the sole purpose to trick us into a potential copyright violation and/or situation. Therefore by e-mailing me and/or viewing this websight, you acknowledge the following statements: 1. You aren't working for any television or movie production studio/network or affiliated organizations, 2. You aren't employed by, or am a member of a professional organization such as ASCAP or MPAA or any other such groups or associations, 3. You aren't employed by the federal government, affiliated agency or any type of sub-contractor or independent agent, 4. You are not a postal inspector, not an individual wishing/wanting to place me into a copyright violation and/or situation or trying to shut down Back In The Day and/or any other websight's that are owned and/or operated by Back In The Day, 5. You agree that the shows listed on my website are believed to be in public domain. These are collector to collector trades and/or sales that are intended for home viewing only. All titles are believed to be in the public domain, with no rights given or implied. I believe these shows to be unavailable to the World, and I'm making them available solely for collectors enjoyment. These tapes are not meant to infringe on any existing copyright violation. Your money is put towards this cause and is spent on: * the cost of your tape(s), - maintaining the quality of shows, - electricity to operate the equipment (TV, VCR), - tape cleaner to clean VCR and keep in top condition, * cost of envelope to ship your tape(s), and You agree with all of the above listed conditions/terms and that your profile does not match anything listed on this page. If the COPYRIGHT HOLDER has a problem with any title(s) being listed, please notify us on an OFFICIAL LETTERHEAD with complete copyright notification and the title(s) will be removed. If you enter this site not agreeing with the above statement you are violating code 341.322.12 of the Internet Privacy Act of 1995 which means you can not threaten our ISP or any other company hosting these pages and you can not prosecute any person affiliated with this site.
2. Copyright/Rights
2.1 Any text within graphics referring to or that are names of larger corporations, such as Nickelodeon, Disney, etc. are trademarked by those companies and at no time did they assist in the production of this page or the collection of this information. Some pictures and info were found on other web pages, and those pages were given credit on this site's credit page. If there are images off a particular site, and we do not have their name listed on the credits page, please let us know so we can fix the oversight.
2.2. At no time is the selling of particular shows allowed on this site. All charges placed on the reproduction of any and all video footage are attached to the time, materials, websight costs, and machine wear and tear that it takes to send a copy to the recipient. The individual charges per length of show are only because the wear and tear occurring to the VCR differs due to the shorter / longer show being requested. No profit is made in the selling of videos. All money received through transactions is distributed back into the site, either for more space, video footage, or anything else that may aid the creation of the archive.
2.3 Back In The Day and/or any other websights in Back In The Day are not affiliated, promoted, or sponsored by Nintendo, Pokemon, Disney, and or any other corporation and/or names. All rights are to be recognized to their respective holders.
2.4 All pictures are believed to be public domain. If you are the owner of any picture we will gladly remove it from the websight, just e-mail me with proof (eg. copyright papers).
2.5 Backintheday2000.com, Back In The Day, and all related logos, products and services described in this website are ownership of Back In The Day or as stated, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Back In The Day. In addition custom graphics, button icons, and html are ownership of Back In The Day and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Back In The Day.
3. Additional Policies.
The following policies are incorporated into this Agreement by reference and provide additional terms and conditions related to specific Services we offer:
Each of these policies may be changed from time to time and are effective immediately after we post the changes on our Service. In addition, when using particular Services, you agree that you are subject to any posted policies or rules applicable which may be posted in conjunction with those Services. All such posted polices or rules are hereby incorporated by reference into this Agreement.
4. Electronic Communications. You agree that this Agreement constitutes "a writing signed by You" under any applicable law or regulation. To the fullest extent permitted by applicable law, this Agreement and any other agreements, notices or other communications regarding your account and/or your use of the Service ("Communications"), may be provided to you electronically and you agree to receive all Communications from Back In The Day in electronic form. Electronic Communications may be posted on the pages within the Back In The Day website and/or delivered to your e-mail address. You may print a copy of any Communications and retain it for your records. All Communications in either electronic or paper format will be considered to be in "writing," whether or not you have received or retrieved the Communication. Back In The Day reserves the right but assumes no obligation to provide Communications in paper format if you address is provided.
